iDefNet VPNTerms of Service

1. Parties and company roles
"iDefNet VPN" is a VPN service offered through idefnetvpn.com and the iDefNet VPN iOS application.
AppVisia LTD, a company registered in England and Wales under company number 17211529, with its registered office at 71-75 Shelton Street, Covent Garden, London, WC2H 9JQ, United Kingdom, operates idefnetvpn.com and sells website subscriptions.
For purchases completed through idefnetvpn.com, AppVisia LTD is the contracting seller and merchant of record. AppVisia LTD is responsible for website billing, subscription administration, customer support, cancellations, refunds and payment disputes.
The iDefNet VPN iOS application is published on the Apple App Store by UP IN THE AIR LTD, a company registered in England and Wales under company number 14085421, with its registered office at 34 The Close, Harpenden, England, AL5 3NB. UP IN THE AIR LTD publishes and maintains the iOS application under a software licensing and distribution agreement with AppVisia LTD.
In these Terms, "we", "us" and "our" refer to AppVisia LTD in relation to website subscriptions, billing, website accounts and customer support. References specifically relating to publication and technical operation of the iOS application may also include UP IN THE AIR LTD.
2. The Service
The "Service" includes the idefnetvpn.com website, website subscription and account services, VPN access made available to eligible subscribers, and the iDefNet VPN application for iPhone.
The Service is currently available through compatible iPhone devices. References to other platforms apply only when applications for those platforms are actually made available.
3. Website subscriptions
Website subscriptions are purchased from AppVisia LTD. Before completing a purchase, you will be shown:
- the amount charged immediately;
- the duration of the initial billing period;
- any introductory price;
- the regular renewal price;
- the renewal frequency;
- the automatic-renewal terms;
- the available cancellation method.
Payments are processed by Stripe or another payment processor acting on behalf of AppVisia LTD. The payment processor may collect and process payment details under its own privacy policy.
4. App Store subscriptions
Subscriptions purchased through the Apple App Store are separate from website subscriptions. Apple processes App Store payments and manages the associated billing relationship. App Store subscriptions must be managed or cancelled through the Apple ID subscription settings. Requests for refunds of App Store purchases must normally be submitted to Apple.
Prices, introductory offers and renewal conditions available through the App Store may differ from offers available on idefnetvpn.com.
5. Digital delivery and access
Website subscription access begins after successful payment confirmation. After purchase, the customer receives account or sign-in instructions. The customer must install the iDefNet VPN application from the official Apple App Store and sign in using the account associated with the website purchase.
If access is not activated after successful payment, the customer should contact support@idefnetvpn.com. AppVisia LTD will investigate account and billing access issues.
6. Automatic renewal and cancellation
Website subscriptions renew automatically at the billing interval and renewal price shown before purchase, unless cancelled before the next renewal.
Website subscriptions can be cancelled through the Stripe-hosted subscription management portal or by emailing support@idefnetvpn.com. Cancellation prevents future renewal charges. Unless otherwise stated or required by law, access continues until the end of the paid billing period.
App Store subscriptions must be cancelled separately through Apple.
7. Refunds
Website purchases are governed by the Refund & Cancellation Policy published on idefnetvpn.com. Where the 30-day money-back guarantee applies, a customer who submits a valid request within 30 days of the initial website purchase will receive a refund of all website subscription charges made during that initial 30-day period.
App Store purchases are subject to Apple's refund procedures and policies.
8. Eligibility
You may use the Service only if you are at least 18 years old, or have reached the age of legal majority in your jurisdiction, or use the Service with the consent and supervision of a parent or legal guardian. The Service is not available to persons under 13 under any circumstances, or to anyone whose account we previously terminated for violating these Terms.
9. Your account
You are responsible for keeping your account credentials confidential and for all activity that occurs under your account. Notify us immediately at support@idefnetvpn.com if you suspect unauthorized use of your account. Your subscription is for your personal use on your own devices; accounts may not be shared, resold or transferred.
10. Acceptable use
You agree not to use the Service to:
- violate any applicable law or regulation, or infringe the rights of others;
- send spam or other unsolicited communications;
- distribute malware, or attempt to gain unauthorized access to systems, networks or data;
- engage in fraud, harassment, or the distribution of illegal content of any kind;
- interfere with, probe, scan or disrupt the Service or its infrastructure;
- resell or commercially redistribute the Service without our written permission.
We may suspend or terminate accounts that violate this section, without refund of the current billing period.
11. Software licence
Subject to these Terms and an active subscription where required, AppVisia LTD and its licensors grant you a limited, personal, non-exclusive, non-transferable and revocable right to access the Service and use the iDefNet VPN application on compatible devices that you own or control.
No ownership rights in the application, website, VPN infrastructure, trademarks or other intellectual property are transferred to you.
12. Intellectual property
The idefnetvpn.com website, subscription system, brand assets, software, application and related Service components are owned by AppVisia LTD, UP IN THE AIR LTD or their respective licensors.
The iDefNet VPN iOS application is published by UP IN THE AIR LTD. AppVisia LTD is authorised to market the Service and sell website subscriptions under a software licensing and distribution agreement. You may not copy, modify, reverse-engineer, or create derivative works of the Service except where the law expressly permits.
13. Service availability
We work to keep the Service available at all times, but actual speeds, server availability and coverage may vary and depend on the internet, third-party infrastructure and factors outside our control. The Service may be briefly unavailable during maintenance, updates or due to events beyond our reasonable control (force majeure).
14. Privacy
Our Privacy Policy explains what data is collected, which company is responsible for it and how it is used, and forms part of these Terms.
15. Third-party services
The Service may link to or interoperate with third-party services (for example the Apple App Store or payment providers). Those services are governed by their own terms and privacy policies; we are not responsible for them.
16. Disclaimer of warranties
THE SERVICE IS PROVIDED "AS IS" AND "AS AVAILABLE". TO THE MAXIMUM EXTENT PERMITTED BY LAW, WE DISCLAIM ALL WARRANTIES, EXPRESS OR IMPLIED, INCLUDING MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE AND NON-INFRINGEMENT. WE DO NOT WARRANT THAT THE SERVICE WILL BE UNINTERRUPTED, ERROR-FREE OR COMPLETELY SECURE.
17. Limitation of liability
TO THE MAXIMUM EXTENT PERMITTED BY LAW, OUR TOTAL LIABILITY FOR ANY CLAIM ARISING OUT OF OR RELATING TO THE SERVICE IS LIMITED TO THE AMOUNT YOU PAID US IN THE 12 MONTHS BEFORE THE EVENT GIVING RISE TO THE CLAIM. WE ARE NOT LIABLE FOR INDIRECT, INCIDENTAL, SPECIAL OR CONSEQUENTIAL DAMAGES. NOTHING IN THESE TERMS EXCLUDES LIABILITY THAT CANNOT BE EXCLUDED UNDER APPLICABLE LAW, INCLUDING YOUR STATUTORY RIGHTS AS A CONSUMER.
18. Termination
You may stop using the Service and cancel your subscription at any time. We may suspend or terminate your access if you materially breach these Terms. Sections that by their nature should survive termination (including sections 12, 16, 17 and 20) survive.
19. Changes to these Terms
We may update these Terms from time to time. The current version is always available on this page with its effective date. For material changes we will notify you by email or in the app before the changes take effect. Continued use of the Service after the effective date constitutes acceptance of the updated Terms.
20. Governing law and disputes
These Terms are governed by the laws of England and Wales, without prejudice to any mandatory consumer-protection rules of your country of residence. Before starting any formal proceedings, please contact us at support@idefnetvpn.com — most issues can be resolved quickly by our support team.
